Terms and Conditions for My Company

Welcome to Envion PTY LTD also referred as “Envion” from here thereof! These Terms and Conditions outline the rules and guidelines for using our digital services. By accessing or using our services, you agree to comply with these terms. Please read them carefully before proceeding.


1. Acceptance of Terms

By using the services provided by Envion, you confirm that you are at least 18 years old or have the legal capacity to enter into a binding agreement under South African law. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.


2. Description of Services

Envion provides digital services, including but not limited to software solutions, cloud-based platforms, data analytics, and customer support. These services are designed to help businesses streamline operations, enhance productivity, and achieve their goals.


3. User Responsibilities

As a user of Envion’s services, you agree to:

  • Provide accurate and complete information when creating an account or using our services.

  • Use the services only for lawful purposes and in compliance with these terms and applicable South African laws.

  • Not engage in any activity that disrupts or interferes with the functionality of our services.

  • Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.


4. Payment Terms

4.1 Deposit and Advance Payments

  • For certain services, Envion requires a 50% deposit before commencing work. The remaining balance must be settled within 48 hours of project/service delivery and acceptance by the contractor (user).

  • For other services, Envion requires full payment in advance before any work begins.

  • Payments must be made in the currency specified by Envion and are non-refundable unless otherwise stated in these terms.

4.2 Refund Policy

  • A refund will only be issued if Envion is unable to finalize a project or provide a service as agreed.

  • Refund claims must be submitted within 15 business days after the delivery of the project/service. No refunds will be processed after this period.

  • If the contractor (user) fails to provide critical or vital information required for Envion to finalize or provide the project/service, the deposit will be forfeited.

  • If there is no communication from the contractor (user) for a period of 60 natural days after the delivery date, despite Envion’s efforts to make contact, the deposit will be forfeited.

4.3 Intellectual Property Rights

  • Until the full payment has been received and cleared into Envion’s bank account, all intellectual property rights, copyrights, and trademarks related to the project/service will remain the property of Envion.

  • Upon full payment, ownership of the final deliverables will be transferred to the contractor (user), unless otherwise agreed in writing.


5. Intellectual Property

All content, software, trademarks, and intellectual property associated with Envion’s services are owned by or licensed to us. You may not copy, modify, distribute, or reproduce any part of our services without prior written consent from Envion, in accordance with South Africa’s Copyright Act and other relevant intellectual property laws.


6. Privacy and Data Protection

Your privacy is important to us. Envion collects and processes personal data in accordance with South Africa’s Protection of Personal Information Act (POPIA) and our Privacy Policy, which is incorporated into these terms. By using our services, you consent to the collection and use of your data as outlined in the Privacy Policy.


7. Limitation of Liability

Envion strives to provide reliable and high-quality services, but we cannot guarantee that our services will be error-free or uninterrupted. To the fullest extent permitted by South African law, Envion shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.


8. Termination

Envion reserves the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including but not limited to a violation of these terms. Upon termination, you must cease all use of our services.


9. Changes to Terms and Conditions

Envion may update these Terms and Conditions from time to time to reflect changes in our services or legal requirements. We will notify users of any significant changes, and continued use of our services after such changes constitutes acceptance of the updated terms.


10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be resolved exclusively in the courts of South Africa.
